1. Acceptance of Terms
By accessing and using the Metro Span Rail platform and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.
2. Services
Metro Span Rail provides international freight forwarding, shipping logistics, and cargo management services. Our services include but are not limited to: quote preparation, shipment booking, cargo tracking, documentation management, and customs clearance coordination.
3. Quotations and Pricing
- All quotations are valid for the period specified on the quote document.
- Prices are subject to change based on carrier rates, fuel surcharges, and regulatory changes.
- Additional charges may apply for delays, storage, or services not included in the original quote.
- All amounts are quoted in the currency specified and are exclusive of applicable taxes unless stated otherwise.
4. Payment Terms
Payment is due as per the terms specified on each invoice. Late payments may incur interest charges. Metro Span Rail reserves the right to withhold services or documentation for overdue accounts.
5. Liability and Insurance
Metro Span Rail acts as a freight forwarder and intermediary. Our liability is limited to the extent permitted by applicable international conventions (including the Hague-Visby Rules, Hamburg Rules, or Rotterdam Rules as applicable). Customers are strongly advised to arrange appropriate cargo insurance.
6. Customer Responsibilities
- Provide accurate cargo descriptions, weights, and dimensions.
- Ensure cargo complies with all applicable regulations and is not prohibited or restricted.
- Obtain all necessary export/import licenses and permits.
- Properly package and label cargo for international transport.
- Maintain accurate and up-to-date account information.
7. Platform Usage
Customer portal accounts are for authorized personnel only. You are responsible for maintaining the confidentiality of your login credentials. Unauthorized access or misuse of the platform may result in account termination.
8. Force Majeure
Metro Span Rail shall not be liable for delays or failures in performance caused by circumstances beyond reasonable control, including but not limited to: natural disasters, war, government actions, port congestion, strikes, or pandemics.
9. Governing Law
These terms shall be governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes shall be subject to the exclusive jurisdiction of the courts of South Africa.
